2. Order Process

2.1 Our display of products on our website is an invitation and not an offer to sell those goods to you.

2.2 An offer is made when you place the order for your products. However, we will not have made a contract with you unless and until we accept your offer.

2.3 We take payment from your card when we process your order and have checked your card details. Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as possible.

A full refund will be given if you have already paid for the goods. It is our aim to always keep our website updated and all goods displayed, available.

2.4 If you enter a correct email address we will send you an order acknowledgment email immediately and receipt of payment. These are not an order confirmation or an order acceptance from us.

2.5 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the goods you have ordered are dispatched from our premises to be delivered to the address you have given us.

2.6 The contract will be formed at the place of dispatch of the goods. All goods, wherever possible, will be dispatched within 24 hours of the order being placed, Monday to Thursday. If your order falls on a weekend or bank holiday, your order will be dispatched on the next available working day. All orders that are sent recorded delivery will require a signature. In the majority of cases, however, we will dispatch goods using Royal Mail’s standard First Class delivery service.

2.7 We do not file details of your order for you to access so please print out these terms and conditions and the order acknowledgment for your own record.

Terms and Conditions Payment

3. Payment

3.1 Payment may be made by any single one of the methods indicated on our website; we are unable to process orders with more than one method of payment.

3.2 You will be charged the current price for buying goods from our website at the date you place your order.

3.3 A delivery charge will be applied at checkout, please view our delivery charges.

3.4 For the convince of our customers we aim to show prices in the correct local currency to their region. We reserve the right to adjust the currency conversion from GBP to any conversion rate we see fit.

3.5 We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price. If we are unable to contact you, we will treat the order as cancelled. We will not accept an order if there is a pricing error.

Terms and Conditions Delivery

4. Delivery

4.1 We deliver to any UK address including most BFPO. We also offer delivery international delivery to most countries that the Royal Mail postal service ship to; this includes:

France, Germany, Spain, Sweden, Switzerland, United States, Australia, New Zealand, the EU States and Canada.

You will be required to pay an international postage surcharge for orders outside the UK. The international shipping surcharge is made available at checkout. If this is not selected and the full postage is not made we will contact you to inform you that the surcharge has not been paid. We will not dispatch your goods until the full postage amount is paid.

4.2 Orders may require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed.

If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted.

4.3 Orders are dispatched from our offices within 24 hours during normal working hours of the order being received. All orders are dispatched via Royal Mail and can between 1-5 days to arrive dependant on the delivery option selected during checkout. All orders placed on a Friday after 1pm will not be processed until the following Monday.

4.4 If your order fails to arrive due to an incorrect/misspelled address when you placed your order, we cannot be responsible for this error. If the item is returned to us from our courier, we will resend you order – subject to an additional postage fee. If the order is deemed lost due to an incorrect/misspelled address, we cannot be held responsible for this and the full package price will be required if a replacement is required.

Terms and Conditions Returns

5. Cancellations and Returns

5.1 If, for any reason, you wish to do so you have the right to cancel any order you have placed. Where the goods have been delivered to you, you may cancel them up to 7 working days, starting from the day after the goods were received, in line with the Consumer Protection (Distance Selling) Regulations.

It is advisable that all items returned are sent Recorded Delivery for your own protection as we cannot be responsible for goods lost in transit. In the unlikely event you are not satisfied with your purchase or there is a fault with the product, please return your order, along with a covering note with the following details:

– Order ID / Transaction ID

– A clear explanation of why the product is being returned

– Full name & Address

– Contact Number

Goods returned for refund must be in ‘as new’ saleable condition. Once the seal is broken on a product, it is no longer in a resalable condition and therefore cannot be returned. Once the item has been registered, it is no longer in a resalable condition and therefore cannot be returned. Goods returned for refund will be remotely disabled so you will not be able to continue to use them even if installed on your PC. In line with the Consumer Contracts Regulations, there are some goods you can’t return if you simply change your mind, these include, but are not limited to, CDs, DVDs or software if you’ve broken the seal on the wrapping.

5.2 Many of our products come with a 30 day money back guarantee. The guarantee does not apply to webinars, 1 to 1 training, downloadable software, bespoke services or packages which contain courses/webinars included as part of the package. The 30-day money back guarantee includes the initial purchase only, and does not apply to subscriptions. The 30-day money back guarantee does not apply if you order 3 or more guides or resources from this site. This is to protect how2Become.com from potential abuse of the guarantee.

5.3 If you are unable to attend your scheduled webinar booking you can contact us within 5 days of the commencement of your course to arrange an alternative date. Please note we can only allow you to reschedule on 1 occasion. We are unable to offer an alternative webinar date without incurring further charges, if you do not notify us of your intention to attend the webinar by the 5-day deadline, or if you have already rescheduled previously.

We are not able to offer refunds for cancellations for reasons outside our control on the customer side, including illness, internet issues on the day, or device failure. If applicable an alternative date will be made at How2Becomes discretion.

The following procedures for returning unwanted goods will apply:

If you have contacted us to cancel before delivery of your goods, though your order will have been cancelled, normally delivery cannot be interrupted (except possible if cancellation takes place within 30 minutes of order). Terms and Conditions Online Testing Suite

6. ONLINE TESTING SUITES & ONLINE RESOURCES (FREE TRIALS / SUBSCRIPTIONS)

6.1 Many of our services include free trials to online testing suites, courses, or training videos. We offer a popular free trial period for our online psychometric testing suite, tailored to individual careers or assessments, that is commonly part of most services we provide on this site. Please note, all users are only permitted one free trial per online testing suite.

After the trial has expired, access is then charged at the rate indicated at the bottom of the webpage or at checkout. You are able to cancel at any point before the 30 day free trial ends by submitting written request via email to [email protected] or by letter to HowBecome Ltd, How2Become Ltd, Suite 4, 2 Mount Sion, Tunbridge Wells, Kent, TN1 1UE. If you wish to cancel a subscription, you must inform us of your intent with at least 48 hours before your next month’s renewal date begins to avoid being charged.

The online testing is provided on a monthly basis with no minimum contract and can be cancelled at any point by providing written notice in the format stated above. Please be aware, if you attempt to cancel via the unsubscribe links in our emails, this will only unsubscribe you from general correspondence and newsletters, ie special offers etc, and you will continue to be charged. These terms also apply to our Jobs Alerts Service.

Please note: some online services we offer may provide a 7-day or 14-day free trial before a subscription payment is taken. This will be clearly marked on the product page, at checkout, and on your receipt. If you are unsure or have any questions, please do not hesitate to contact us anytime.

If you have purchased an online How2Become course through the website Reed.co.uk, you are entitled to a 14-day refund period as long as the course hasn’t been accessed. To cancel a course purchased through Reed, please contact their customer support or email us at [email protected].

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Section C - AFFILIATE TERMS AND CONDITIONS

IMPORTANT: Please ensure that you read the entire Affiliate Terms and Conditions (Agreement) carefully before registering and promoting Intelligent HQ Ltd (How2Become.com) as an affiliate (Affiliate).

Your participation in the Partner Program (Affiliate Program) is solely to legally advertise our website to receive a commission on subscriptions and products purchased by individuals referred to How2Become.com by your own website or personal referrals.

By signing up for the How2Become.com’s Partner Program, you indicate your acceptance of this Agreement and its terms and conditions.

Approval or Rejection of the Application

How2Become.com reserves to right to approve or reject ANY Partner Program application at our sole discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

Commissions

Commissions will be paid upon contacting us to request account balance and payment. We will then look into earnings to ensure accurate data (for example, commission may have been earnt upon a successful referred order, but that customer may have subsequently requested a refund. In this scenario, zero commission will have been earned by the Affiliate).

You may not refer yourself and only one commission may be earnt per referral. For example, if a customer makes two purchases under two accounts, you will only be paid commission for the first order.

Transactions that result in refunds or chargebacks will not be paid out, only successfully completed orders will earn commission.

Termination

Your Partner Program application and status in the Program may be suspended or terminated for any of the following reasons without any notice:

  • Promotion on coupon websites.
  • False claims or inappropriate advertisements (misleading hyperlinks, no mention of paid affiliation etc.).
  • Failure to keep customer’s data safe or to abide by the Data Protection Act 2018.
  • Spamming (mass link spamming, email blasts, etc.).
  • Advertising on sites containing or promoting illegal activities.
  • Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement.
  • Violation of intellectual property rights. How2Become.com reserves the right to require license agreements from anyone who wishes to use our branding or content.
  • Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive.
  • Self-referrals, fraudulent transactions, suspected Affiliate fraud.

IMPORTANT: In addition to the above reasons for termination, How2Become.com reserves the right to terminate any Partner Program account at any time, for any violations of this Agreement or no reason.

Pay Per Click (PPC) Policy and Coupon and Deal Sites

Promoting your affiliate links on any coupon site, discount site or via PPC bidding is strictly forbidden and a violation of these terms.

Liability

How2Become.com will not be liable for indirect or accidental damages. This includes, but is not limited to: loss of revenue, loss of commissions etc, due to loss of database files, affiliate tracking failures, Partner Program account closure, product changes, any results of intents of harm to the Partner Program and/or to our website(s), or for any other reason.

Our services may contain errors, be interrupted (for instance, due to maintenance, site closure, hacking etc.), and therefore, we do not make any warranties, or accept any liability for any indirect or accidental damages.

Indemnification

All Affiliates shall indemnify and hold harmless How2Become.com and its affiliate and subsidiary companies, directors, employees, licensees, and successors and assigns from any and all liabilities, fines, damages, claims, costs, judgments, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate, or the closure of Partner Program accounts. This includes those who are licensed or authorised by How2Become.com to display, offer, and distribute materials.

Term of the Agreement

The term of this Affiliate Terms and Conditions Agreement begins upon your acceptance in the Partner Program.

We reserve our right to modify the terms and conditions of this agreement at any time without notice. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Partner Program will constitute your acceptance of any change.
